I'm wary of using corruption as a reason for removal since that's the name of a criminal charge. We've had enough arguments when overlapping names are used previously. Maybe revise the wording of that section?

I would support striking that word entirely. Removal by the Assembly for abuse of power seems sufficient to me. What do you think?

Perhaps the Assembly could remove for any reason, and the CRS could remove for proof of abuse of power/corruption as well as for inactivity or ineligibility (or perhaps start an expedited removal vote)? I'm thinking specifically of urgent situations where waiting for the Assembly to debate and vote is too long, and elections are in immediate risk.

It seems to me that giving the Assembly the power to remove the Commissioner for any reason — or, rather, without a reason — would render the system too unsubstantial factors or minor disagreements that might serve to delay or impede the election but do not amount to an abuse of power or corruption. To address the possibility that the Commissioner is impeding the election due to inactivity, I would be more inclined to support something similar to the following:

(4) The Commissioner will be a permanent position and shall be replaced as needed due to inactivity or ineligibility by the Council on Regional Security. The Assembly may remove, by a majority vote, a Commissioner for corruption or abuse of power or neglect of responsibilties.

My mind's not really made up on this though, so feel free to convince me otherwise.

Relevant Articles and Sections: Article 1 (Election Commission) and Article 2 (Electoral System).


Article 1 after amendment Wrote:1. Election Commission

(1) An Election Commissioner will be appointed by the Council on Regional Security to administer all forum elections.

(2) The Commissioner will be responsible for the creation of election notices, the organization of election forums, the verification of candidate eligibility, the distribution and collection of ballots, and counting and verifying cast ballots.

(3) The Commissioner may not run for office or hold the office of Delegate, Prime Minister, or Cabinet Minister, during their tenure as Commissioner.

(4) The Commissioner will be a permanent position and shall be replaced as needed due to inactivity or ineligibility by the Council on Regional Security. The Assembly may remove, by a majority vote, a Commissioner for abuse of power or neglect of responsibilities.

(5) Any election-related disputes will be arbitrated by the Commissioner; should the dispute be on a matter of law, the Commissioner shall refer it to the High Court. The Commissioner will not finalize any election until all disputes have been settled.

(3) Voters will have the option to cast their privately vote using a secret ballot. The method of private voting will be selected by the Election Commission. The method must utilize an unaffiliated account or server, with the method and all votes remaining available for audit. Named ballots are not to be released under any circumstances.

(4) To be eligible to be included in a voting ballot, any candidate must post a campaign in an area designated by the Election Commission. The campaign must prominently include a truthful declaration of all potential conflicts of interest the candidate may have within and outside of the South Pacific.

I think we should also include an amendment to include Local council elections under the formal jurisdiction of the EC since the elections act doesn’t extend gameside

Would it not be more appropriate for the Local Council to pass a law to make for such an allowance, or perhaps, amend what it currently has?

It may be more appropriate for the local council to pass to formally include an election commission. However, since the groundwork for the EC is already in the Elections Act, I think it would be better to expand the authority of the Election Commission to extend game side since they are essentially appointed by the CRS or court
