Had I presented evidence of lost endorsements as a result of these false claims, would that have met the threshold of proving damages? I didn't document the deteriorating game endorsements at the time, however, I would certainly have done so had I known that I needed to prove damages concurrently with the process of filing the complaint. I had assumed that proving damages would be required after the Court recognized the case, not before. I'm not seeking to reopen or further litigate this matter, I am just trying to understand the process how the court seeks to handle defamation complaints, considering there is very little (no?) case law on the topic since the law was adopted by the Assembly.
