Executive action: Contested election
#41

The problem is precisely that we cannot say for sure that Wolf has been elected to office. The Cabinet is not preventing someone from taking their office, it is ensuring that whoever takes the office has been legally elected. We would be more than happy to accept Wolf if the Court rules in his favour, but that is the point: there must be a Court ruling that clarifies the issue.

However a valid election result exists, and until such time it is proven invalid it is still the legal result.

Not if the action that permitted its certification (the exclusion of one vote) can be argued to be invalid. It is up to the Court to make that determination.

I don't think a cabinet action will really resolve this. The Assembly may need to do something.

Shame we are not able to initiate a "Vote of No Confidence" for our Government eh?

You're the only one with zero confidence in the government.

^ I wouldn't say he has zero confidence. Could be wrong. As for me, the credibility of the cabinet has been significantly reduced. It's rather shocking.

I think not, there has been a fair amount of criticism and concern expressed about Cabinet decisions recently, this discussion being the latest example

Not all criticism is factual.
