I'm just going to say that these kinds of things should be addressed before the elections begin rather then afterwards. Otherwise it seems opportunistic.

Seems is a nice way to put it.

You're welcome to be more precise but be careful that you don't add fuel to the drama. That would be unseemly.

<Xoriet>: He's arguing that Kandarin was never in TEP Empire.
<Neenee>: Kandarin was helping out in RP
<Neenee>: Can't remember what title, if any, he was given
<Neenee>: But he was there and active.
<Xoriet>: Mind if I post the two lines saying that Kandarin was helping out in RP and he was there and active?
<Neenee>: Nah, go ahead.
<Neenee>: I'd have to go back over the forum again to see how active, but he was there, and he was posting in the RP

Hope this helps, Unibot. Never hurts to go straight to the source and ask.

I mean I disagree with declaring people affiliated with Empire a threat or denying them citizenship in general so therefore this focus on an ipso facto "technicality" is to me a useless waste of time rather then the run-off or special election and clarification of EC powers.

First: It's totally irrelevant whether Kandarin was or was not in TEP's Empire. The only thing that should be said is that Kandarin should have declared a CoI saying he was a member of The Empire if he was a member of The Empire - however, since Kandarin never applied to join for citizenship, as far as I know, it's totally a moot point!!

Second: You and others seem to be under the impression because I am the delegate of The Rejected Realms that I am by extension, automatically, a fanboy of Kandarin. He seems like a nice fellow but I never trusted him when he was around - largely because he was friends with people who didn't have very much respect for GCR sovereignty. Aka. Empire. Not to mention the fact that he handed his account without the consent of TRR to Nai and by extension, The Empire. It was months upon months of arguing with Biyah before things in TRR were ever settled. If you had told me he was a card-carrying member, I'd believe you.

Third: I never argued Kandarin wasn't in The Empire. All I said was I didn't know if he was...

Fourth: It's still totally irrelevant!!

Quote:I mean I disagree with declaring people affiliated with Empire a threat or denying them citizenship in general so therefore this focus on an ipso facto "technicality" is to me a useless waste of time rather then the run-off or special election and clarification of EC powers.

First: I would argue this is the clearest violation committed during the election; CoIs have always been required to be specific - Empire is considered a threat, whether you consider it a threat - we've recently had two people who were denied because their former Empire membership flagged them as a threat to the VD. If you're a former member of The Empire like Wolf is, you need to disclose your membership in The Empire explictly - it's an organisation. Failing to disclose your membership in The Empire is either a major oversight or a deliberate omission - but either way it would have misled voters.

Second: Why does it matter if you think a question is a "waste of time" compared to two other open legal questions? It's not a competition. The only thing that could possibly be said to be wasting the court's time are these off-topic posts from you and others. The courts can handle three or more legal questions - and I consider this one to be vitally important.

Finally,

Quote:I'm just going to say that these kinds of things should be addressed before the elections begin rather then afterwards. Otherwise it seems opportunistic.

I didn't notice the omission in the Conflict of Interest until later - I was busy running a campaign of my own. It had been mentioned that Evil Wolf had left out disclosing his membership in The Empire in his citizenship application - so I thought, 'I wonder if he had disclosed it in his Conflict of Interest sheet'? And he had not.

I don't particular care if this legal question 'seems' opportunistic. 'Seeming' opportunistic doesn't affect whether the question's answer is 'yes' or 'no'. Asking the right questions is more important to the law than asking only the questions that makes me look good. That's because I value the rule of law more than my image, which apparently it could be said, Evil Wolf doesn't share ... when he failed to disclose his former membership with The Empire!

I'd just like to point out that the precedent you mentioned in your first post Uni is a slightly different situation. TUSR just didn't follow the requirements for a COI at all, rather than leaving one item out. The COI mentioned can be found here for reference:

http://thesouthpacific.x10.mx/thread-1298.html

Not saying it is better or worse, it is probably not a fair comparison though, which the justices on this case (I will not be one of them) may not have been aware of.

The point still stands however, that there is an organization called "The Empire", who was responsible for actions in Osiris, was based off The Empire of The East Pacific, and is what Unibot is directly saying I was a part of.

However, I had nothing to do with Osiris and I am not part of "The Empire" that was involved in other regions. That organization is merely based upon The East Pacific Empire and formed years after the original Empire of The East Pacific dissolved.

I believe I have filled out my form correctly. Unibot is saying I didn't because of a technical issue. Well, that's his opinion verses my opinion, but in the end I had no intent to omit anything and even listed my nation in The East Pacific as an aliases.

I wasn't being deceptive when I said I was in The East Pacific, and I'm not being deceptive when I say I'm not part and was never part of The Empire that exists today, which has taken to life long after "The Empire of The East Pacific" coup was over.

I challenge Unibot, who is the accuser and bares the burden of proof, to prove that I have otherwise thought these two entities were one in the same, and thus intentionally was trying to askew my CoI, rather than firmly believing that they were two separate things, with any inaccuracies, which I still maintain I am correct by-the-by, being accidental rather than purposeful.

You asked for proof. I provided it. Certain people in TSP ask for proof and then say it should be moved elsewhere or is irrelevant. Sad it really makes wanting to contribute in any way an apprehensive prospect. Anything said that isn't beneficial to one party becomes irrelevent or superfluous.
