In hindsight we were damned either way. If we'd said nothing we'd have been criticised for going against a decision of the Assembly to create a LC open to all and now by exercising our function to recommend the Assembly sort it all out, we have an appeal from the other side.  :facepalm:

At this point, I don't care if the entire ruling is undone. If Kris wants to make this unnecessarily difficult, that's his problem.

Im not seeing what the issue is here. We made a recomendation as to how the assembly can bring the lc into legality if its original intent was to make the position open to everyone.

You know TAC I think in the future you should decide ahead of time who the non presiding justice is going to be on a particular case. Seeing as I had to issue a ruling on an appeal for a majority opinion I helped to write made it difficult for me to come up with a ruling. This is not meant as a knock on your tenure as Cheif I just think in order to be completely impartial the non presiding justice should not be involved in discussions of the case he/she might have to make a ruling on appeal.

What do you think?

I've been going on a first come first serve basis. Once the first three Justices that got in on it agree, that's it, I post it, which is why you were put on as the non-presiding justice.

Im not entirely sure what Kris hopes to achieve with this request. Seems to be a witch hunt or gotcha politics. He wants the judiciary to be independent but wants the transcripts to its discussions when a ruling goes against his opinions.
