Possibly, but not necessarily; it would have depended on how that evidence looked by itself, and within the broader context of the case. What the Court considers isn't whether or not someone lied, but rather if that lie (1) was grossly misleading, and (2) caused damages. Based on the evidence we had on your submission, while NHC possibly misrepresented the nature of your telegrams, we were not convinced that it rose to the level of grossly misleading, or that damages had been adequately established.
