Case Submission

 
Your Honours,

I, Belschaft, respectfully submit the following case for consideration by the High Court. I hereby state that the information within this submission is true, to the best of my knowledge, and that there is no malicious intent or vexatious nature to it. I further promise to make myself available to any future questions or request from the Court in order to ensure that this case is fairly considered.

On 29/04/21 the Ministry of Culture announced a "Theme Thursday" competition with a theme of "Very Epic Flags".

On 30/04/21 the Ministry of Culture announced that the Minister of Foreign Affairs was the winner, for the following submission;

This submission is both very clearly not a flag and not epic at all. What is more it was selected over the following submission which is not only a flag, but objectively speaking the most epic flag.

In doing so the Minister of Culture misused their public office by granting a reward to a Cabinet colleague which they neither deserved or were eligible for. This is an undeniable case of both Corruption and Bribery, in which both the Minister of Culture and Minister of Foreign Affairs were complicit.

Further to this, and due to the involvement of multiple Cabinet members in a criminal conspiracy, an additional charge of Organised Crime must be submitted against the Cabinet as a whole, including the Prime Minister, Cabinet Ministers, Cabinet Advisors, and Deputy Ministers. It is clear that under the terms of the Criminal Code the Cabinet has acted as "a group or association" which has committed criminal acts in the South Pacific.

Your honours, as such it is with great reluctance that I must ask for the immediate indictment of the Minister of Culture for the crimes of Corruption and Bribery, the Minister of Foreign Affairs for the crime of Bribery, and the Cabinet as a whole - including the Ministers of Culture and Foreign Affairs - for Organised Crime.

Finally, and with the Cabinet as a whole identified as part of an organised crime group I must ask that the Court issue a temporary injunction suspending all members from office until further notice, and placing the Subversion and Sandwiches Minister in temporary command of the region as a suitable uninvolved individual.

based on the fact that Petitioner is using Discord's light theme feature (a substandard theme even according to Discord itself) Petitioner cannot be assumed to have been of sound state of mind when submitting this case and therefore we urge the Court to dismiss this case with prejudice.

At this point I feel obliged to add an additional complaint against the defendants, as their attorney has made comments which are discriminatory against players with eyesight issues requiring the use of the light theme.

SUBMISSION 01 MAY 2021 | PROBABLE CAUSE 02 MAY 2021


Whereas this Court has been asked to exercise the judicial power vested in it by the Government Island Judiciary Act, it is resolved as follows:

FINDING OF PROBABLE CAUSE
This case is found to have probable cause and shall be duly considered under all designations assigned by document 2101.OC.NR.

INDICTMENT
Prarie, Minister of Culture; Roavin, Minister of Foreign Affairs; Sandaoguo, Prime Minister; Vietnam, Minister of Engagement; Islas, Minister of Media; and Witchcraft & Sorcery, Minister of Defence; are indicted on the charges of Corruption, Bribery and Organised Crime and are invited to present a defence no later than 3 calendar days following the publication of this document, either on their own or through an attorney of their choosing.

SUBMISSION OF BRIEFS AMICUS CURIAE
Interested parties may submit briefs amicus curiae to argue their views on the whole or a part of this case no later than 2 calendar days following the publication of this document, and shall thereafter be liable to answer any questions that the Court may have in relation to their brief.

SUBMISSION OF REQUESTS FOR RECUSAL
Interested parties may request the recusal of the Chief Justice or any Associate Justice no later than 1 calendar day following the publication of this document. Any such request should provide clear reasons to support the requested recusal and explain the possible negative impact of a failure to recuse.

RETENTION OF RIGHTS
The Court retains the right to consult with, and request further testimony and evidence from, government institutions and other third parties as necessary to adequately exercise its sole right to issue an opinion on this case.
