Assembly Resolution to Compel the Release of Cabinet Discussions


Acknowledging the request for Cabinet discussions in accordance with the Sunshine Law by Hileville.

Noting the lack of the Cabinet to process the request within a reasonable time.

Hereby,

Orders the Cabinet to release the following discussions:

1.  Operation Brave Toaster - Any and all discussion which resulted in the release of this Cabinet Statement.
2.  Independence and Regional Sovereignty Conferences - Any and all discussion which resulted in the release of this Cabinet Statement.
3.  Removal of Belschaft's Citizenship on Security Grounds - Any and all discussion which resulted in the release of this Cabinet Statement.



I requested the above threads on 3/19 which is almost a month ago.  We have had 2 cabinets seemingly ignore their responsibility to answer a petition for the release of discussions.  We were told that the Cabinet had an informal agreement to release the threads after the Cabinet election in March.  We were then told that only half of the 1st Cabinet that was processing the request bothered to reply.  We were again told that the answer is believed to be a yes but they haven't looked through it yet.

Whether intentional or not 2 Cabinets have delayed the handling of this request.  This cannot be allowed to happen when a Citizen requests threads which is why I am proposing this resolution.

I am not a fan of resolutions compelling Cabinet action, which is why I will stand against this. While I am disappointed that the petition has not been acted upon, I believe that the law already describes the disclosure process, and circumventing that through a resolution, while certainly well-intentioned, is not the way to go. The threads requested will be up for mandatory disclosure at most later this year, anyways.

I do urge the Cabinet to attend this matter as soon as possible and either grant or refuse the request, particularly since at least one of the threads in question is already due for disclosure, or should be soon.

Honestly, this probably hasn't been done yet because it's a process normally led by the Delegate, and Tsu has been busy as it's the end of the semester.

There doesn't seem to be an argument for a pressing need for the Assembly to take up this resolution. And unless you're accusing the Cabinet of purposefully ignoring your request, then passing a resolution isn't going to make the process go any faster.

Furthermore, OBT was revealed 6 months ago. Belschaft was declared a security threat not that long ago. So the Cabinet isn't under any legal obligation to release any of their discussions for, at the very least, another 2 months.

Hile — I said this earlier and, I'm pretty sure I speak for the entire Cabinet. We're happy to do this, but we've been a bit busy.

I've been a bit tied up, Pen had been a bit tied up and we're down an MoFA. Unfortunately, we're hamstrung by manpower.

However, Henn recently pitched a process for us to go through them, and get them out, so we should have them soon.

It should be noted that a few threads that I went through are clear and set for declassification. Admins? 4 oldest ones, excluding Legitimacy. Please, and thank you, I'll look through the 3, but I make no guarantee that any will be declassified ahead of its 8 month period.

I get that people are busy but it has been almost 30 days. This isn't something that should take that long.

I want a definitive answer on whether these threads will be released based on my petition or not.

I think the Cabinet already made it clear multiple that the threads will be released. The problem is with the personal availability of Ministers.
