The Southern Socialist Union

Trial

We are filing charges against Darkstrait for conspiring against an SSU member, Sporaltryus.

We are also filing charges against Laiwan for not promoting peace and for not promoting socialism.

We would like to expel them from the SSU for these charges.

Under the Socialist Papers, surprisingly, neither of these are actually illegal. Although we agree with Sporaltryus that these should be crimes, there is no such law on the books, and therefore no case.

We were promoting peace. As armed conflict was the only way peace could be achieved, we did. Furthermore, we did not recognize the SRT as a legitimate state, and it was a terrorist organization for us, as the people did not declare it, only the authorities did(and we want a stable neighbor, okay? Plus, we are dependent on Ryccian-Laiwanese commerce).

And as Darkstrait said, these are not crimes since there is no section saying "if a SSU member attacks a socialist state, they will be expelled", or something like that.

Although we do agree that The Sporaltryan Union needs to cite an exact violation as outlined by the Socialist Papers, the charges as Sporaltryus describes them fall clearly under several violations as outlined by the charter, including Failure to Uphold the Charter, and perhaps even Treason, but they do indeed need to cite the exact violation that they are accusing both Darkstrait and Laiwan of before the trials can commence.

We believe that the alleged actions of Darkstrait actually violate the following, with particular emphasis on 1.1.4 and 2.2.7


Article 1 - Nature of the Union


Section 1 - Principles
1. The Union is considered an alliance among its Members.
3. The promotion and preservation of good relations among the Members is considered crucial for the Union.
4. The respect for the independence and sovereignty of the others and non-interference in their internal affairs.

Section 2 - Purposes
1. To encourage Friendship, Cooperation and Mutual Assistance.
2. To guard Peace and Socialism in the South Pacific.

Section 3 - Commitment to the Union
1. The Contracting Parties shall consult with one another on all important international issues affecting their common interests, guided by the desire to strengthen international peace and security.
2. The Contracting Parties undertake, in accordance with the principles of Socialism, to refrain in their international relations from the threat or use of force, and to settle their international disputes peacefully and in such manner as will not jeopardize international peace and security.
3. Exclusively under the imminent danger of one or more of the Members of the Union, for which diplomatic negotiations cannot have results, the treat and use of force are to be allowed after the public approval of the Allied Assembly until the resolution of such conflict.

Article 2 - Integration of the Union

Section 2 - Bill of Rights
7. Right to Participate in Other Organizations and Bilateral Relations, as far as it does not violate the Principles. To avoid any sort of suspicion, the Members are advised to mention the nature of their international treaties to the fellow Members.


Which are sanctioned, [i]with particular emphasis on 4.1.3, under:[/i]

Article 4 - Punitive Actions

Section 1 - Violations of Principles and Acts Against the Union
1. Treason: an act in which the offending nation betrays the Union to another organization

3. Failure to Uphold the Charter: an act in which the offending nation passes legislation or engages in some other action to violate the charter; this includes but is not limited to engaging in war against a fellow member nation or passing legislation to outlaw socialism.


We believe that is Darkstrait duty to prove the leaked document is not a forgery, or if true that  the responsability lies within single individuals and not the government. Should the second case be, we also believe that it will be Darkstrait duty to punish those involved with maximum severity and to implement additional security measures developed by other S.S.U members.
 
Should Darkstrait be unable or unwilling to do so, it shall be punished under:

Section 3 - Even Punishment

1. Punishment for Treason shall be: permanent loss of membership in the Union.

As for Laiwan, we believed that it violated:

Since Laiwan has already presented its defence for its actions, we vote that Laiwan shall be punished under:

Section 3 - Even Punishment
3. Punishment for Failure to Uphold the Charter shall be: temporary loss of membership within the Union.


We will vote in favour of restoring membership only if and when adequate measures have been taken by Laiwan.

We urge Bruuma to reread the leaked document. It in no way implies that Darkstrait even intended to wage war against Sporaltryus. The sole role of Darkstrait in the plot was to make an effort diplomatically to force Sporaltryus out, by whatever means were available. In order to do this, it would be crucial for Darkstrait to avoid war with Sporaltryus, to avoid being ejected.

Which has, for reasons inexplicable to us, become a major possibility anyway.

Then why did Darkstrait fail to notify anyone outside of those listed in the document?

Conspiring with another nation which intends to wage war against a fellow member is no better than waging war directly.

In light of this admission of responsability and no sign of repentance, Bruuma and Puerto Pollo vote AYE in favor of the expulsion of Darkstrait from the S.S.U.

This is preposterous. The distinction between plotting with a country that intends to declare war and actually declaring war is huge.
