Legality of Recalling a Legislator - maluhia - 08-24-2022 HIGH COURT OF THE SOUTH PACIFIC
CASE SUBMISSION I, The Lile Ulie Islands, respectfully submit the following case for consideration by the High Court. I hereby state that the information within this submission is true to the best of my knowledge, and that there is no malicious intent or vexatious nature to it. I further promise to make myself available to any future questions or request from the Court in order to ensure that this case is fairly considered. REFERENCE NAME Legality of Recalling a Legislator ARGUMENT Your honor, Article 11 of the official Charter of The South Pacific is solely dedicated to recalls and motions of no confidence. In Section 1 of Article 11, the Charter states, “Any official of the Coalition may be recalled by an Assembly resolution passed with a three-fifths majority of those voting.” An official of the Coalition would be (I’d think), any public servant, which can range from being a Minister, to SPCG or CRS Member, Local Councilor…and Legislator. Therefore, if a Legislator violates the Criminal Code, or another law/constitutional amendment of the Coalition, could there be a recall attempt (from their position as Legislator)? What if this was gameside, on NationStates, and they were out of the Assembly venues, however, broke a law, could they then be recalled by the Assembly? Now, this question is mainly about Legislators, however, I am wondering the same about Local Councilors. I do not want to put more of a burden on you so I’m just going to include it into the same question. I truly appreciate your service to the Coalition. REQUEST Does Article 11, Section 1 of the Charter of The South Pacific permit the Assembly to recall a Legislator? Submitted to the High Court of the South Pacific RE: Legality of Recalling a Legislator - maluhia - 08-25-2022 Your honor, I wish to withdraw this legal question from the court's premises. |
