Provided that in general, the division is kept, I do not understand why members of the Judicial Branch in times of emergency in terms of activity, are to be actively disbarred from filling junior roles in the government.
It's a conflict of interests situation. Justices shouldn't have privileged Cabinet information, nor should they have an interest in the success of Cabinet policies. Activity isn't a reason to introduce those COIs. There are other people who can fill those positions.

There's also the inherent conflict between the executive and a branch of government meant to, to a certain degree, hold it to account.
