Election Commissioner Corruption

I would be supportive of that. We would have to move up elections so that people don't take up office during that period. I have a feeling that if laws were violated and the results were thus wrong, the "winner" would still get to serve a term because people would hesitate to do anything once they're "officially" in office.

In some ways I feel like this has been part of the intended role of the EC. But, I wouldn't be opposed to giving an appeal to the court.

I don't like the idea of moving up election, however. We're also at quite a lengthy endeavor. What about if a challenge is made those candidates cannot take office until it is decided?

That is an issue that I've yet to properly consider, but off the top of my head, I'd say that in the event this does occur, then I suppose the member of Cabinet holding that post previously serves in the interim?

The slight problem is that if that person was elected into another position. But I think we could legislate that the Cabinet can appoint someone in the interim.

That would have to do, especially if you go by this: http://thesouthpacific.x10.mx/thread-209...l#pid55197

Which I think is better than holding up an election. I don't think it's wise to have a vacant position at all while waiting on the courts, but at the same time someone needs to at least be temporarily working the position if a case drags on.

I will point out that we once had a procedure to contest results. I saw it when reviewing election threads from 2005-2007. I would certainly provide some space to contest results, when there is reasonable suspicion that proper procedure was not followed, and that would in turn benefit the elected party, since it would ensure the legitimacy of their election.
