Separation of Powers
#31

Farengeto's written opinions weren't biased. Let's leave the politics of the coup behind for just one moment and recognize that the coup-backers didn't have a winning legal argument, let alone one that made sense at all.

The coup is a perfect example of how well our court can function when helmed by a responsible appointment. The biggest problem was that the pool of justices for an appeal wasn't deep enough. And that just highlights the fact we don't have a deep bench in TSP for the judiciary to begin with.

We agree the court needs work and can leave it at that for the moment. In as much as this thread is about separation of power, another thought crossed my mind. The Judicial, Executive and legislative branches do need to be separate. TSP has held the sanctity of the Assembly. Elected officials are supposed to further the cause of the charter and the good of the region. We keep the same official, but make the cabinet non legislative. And mostly figure heads. The Delegate represents the region and is head cheerleader and spokesperson to the assembly for the cabinet. Ministers of Foreign affairs and Regional Affairs bo their thing in those areas, the Minister of the Army runs the SPSF however that goes. The cabinet meets and reports to the delegate the status and the Delegate summarizes to the Assembly. What the cabinet does NOT do is decide laws and actions on citizens. If they want something different, they can present it to the Assembly like everyone else. If the cabinet has an issue with a nation or a situation, the cabinet can present it to the court like everyone else and if the court makes an impopular/unjust/just plain wrong decision, it can be overturned by the Assembly. The cabinet would be the group to instigate recalls if a minister isn't pulling thier weight. Being that we do have a limited active group, anyone holding office can always resign as real life happens and people move on, but in TSP, once in office, while you can resign, your banned from holding another office until the end of the term. Would stop the discontinuity this region suffers almost every term.
As far as the forum admins are concerned, they do need leeway in the fact they need to be able to ban spammers and inappropriate threads instantly and I understand that, but tasks like citizen masking can be given to the cabinet member assigned and Ministers get moderation of their areas.
We're the same 20 or so people that have been fighting this fight for years. Just need to chill and let it happen.

Just to catch people up, citizenship is already entirely in the hands of the VD. To the extent that admins are involved in masking, it's for old users whose masking setup doesn't allow the VD to remove them from the citizens usergroup.

And it's shocking how we ended up in a situation where the forum admins are no longer trusted to handle something as basic as maskings, and yet still claim they did nothing to earn that distrust.

I trust the forum admins to handle masking. I just would prefer that the relevant government official do it when that's possible, to avoid future controversy.

Let's stick to the topic at hand and identifying problems for Charter revision, instead of taking shots at each other, shall we?
