RE: [DRAFT] Amendment to the Judicial Act

The Cabinet and Court have presented a (already acknowledged as lacking) statement and the full transcript of the survey and additional questions Belschaft had to answer. Maybe you should follow Serres' and Glen's examples and actually cross examine the nominee, rather than expecting us to give you all the information.

We've presented a nominee that we believe is sufficiently qualified. The onus is now on the Assembly to verify if our belief is well founded.

Personally, I support the Cabinet's decision to nominate Belschaft to Associate Justice. He is a skilled legislator, despite a history of controversial scandals in the region, a former member of the Pool of Justices, and is well versed in the courts. Besides Feirmont, Farengeto, or Glen, I can't think of anyone more qualified at the moment who isn't a member of Cabinet or Court to be an Associate Justice. That being said, while my own interpretation may be painfully narrow, the lack of ensuring a mechanism for some transparency is still a clear flaw in the current scrutiny process.

I don't for a second believe that the refusal to release actual private discussions constitutes a lack of transparency.

I would disagree kris, that is by definition not being transparent, however the question is, should we trust our cabinet members to conduct private discussions after weighing the pros and cons of the matter? I would say yes we should. Again all we really need is a summarized statement that supplied legislators with the basic info they need to ask appropriate questions of the nominee and vote based on the answers to those questions. And to address you Sand, the primary point I’m going to bring up is your statement that Roavins initial summarized statement on this information was lacking in the case of Bels nomination. I agree it was, however so did Roavin and he supplied us with a follow up that was more than sufficient. If anything we should be debating what the outlines of this summary and it’s criteria are rather than wasting our time distrusting the cabinet as you have seen fit to do. The majority of TSP elected these people and in such a small community we have the luxury of providing them with a modicum of trust.

I will only disagree with that initial contention, in that transparency doesn't mean the unrestricted release of any and all information.

Beyond that, I think it's worth remembering that not everything needs to be legislated. People made a point that the nomination statement was lacking. We acknowledged that it was and committed to addressing that in the future. This isn't a fundamental issue that requires legislation.

I feel like this threads existence is evidence enough that this issue needs legislation if only to prevent future legislators from creating debate threads on this topic that serve only to have the assembly argue in circles with one another with no clear goal or end in sight.

Or we can acknowledge that sometimes officials just need to be poked about things that need fixing. This isn't a case of an official that refuses to make logical and needed changes. People told Roavin that something needed improving, and he agreed to make changes. It'll be a different matter if future nominations (including the next one that will come soon) have the same issue, but until then, is there really a problem?

My problem is that this thread exists at all. As you said, Roavin handled the situation and it was resolved. The existence of this debate and it’s high activity is unecessary and I seek to avoid it in the future with the creation of clear, in-depth legislation. We as an assembly r the problem in this case, not Roavin.
