[Draft] Executive Order: Local Council Elections

Given the recent High Court ruling, I propose the following EO to help resolve the situation:

Temporary Suspension of Local Council Elections

DAY August 2020


Fellow South Pacificans,

In light of the recent High Court ruling on the legality of excluding active SPSF members from voting and the resultant need to both correct the most recent Local Council election and to amend our laws so that a practical procedure can legally be followed in future elections, the Cabinet of the South Pacific hereby resolves temporarily to suspend Local Council elections with the intent that the Assembly and the incumbent Local Council work together to amend our laws accordingly as soon as possible. This executive order will be pronounced null and void and Local Council elections resumed once appropriate legislation has been passed to allow the elections to be run in a manner that is as practical, as secure and as fair to all members of the Coaltion as is reasonably possible.

I'm not sure if this is legal. I don't think we are allowed to make EOs that solely affect gameside governance.

The charter gives us fairly sweeping powers in this regard, I think.

The Charter of the South Pacific Wrote:(13) The executive may exercise the collective authority of executive orders, by unanimous consent among the Prime Ministers and Cabinet Ministers. Executive orders may only be issued to address an immediate and pressing issue created by ambiguity or holes in a particular law, which will immediately have the effect of law.

Considering that the High Court just exposed a major loophole in the Charter that basically lets any nation in TSP, even puppets, to vote in LC elections, I think the EO is appropriate for the situation.

That was my first thought as well. Although, I've since reasoned to myself that the Cabinet is the executive branch of the whole region.
