[FAILED] World Assembly reform
#1

Considering the time that the Office of WA Legislation has had in building up its infrastructure, I believe now is a good time as any to introduce a bill that will make the OWL a full-fledged ministry. This proposal also takes into account our joining the Partnership for Sovereignty and how we can operate within a bloc. The bill is threefold: it enshrines the OWL in the Charter, introduces the World Assembly Act to legislatively define its procedures, and postpones its creation until the next Cabinet election, which would be June 2021 and not February considering the time frame of this debate and possible vote.

THE CHARTER OF THE SOUTH PACIFIC

VI. THE EXECUTIVE

(2) The Cabinet will consist of ministers with the following portfolios: Foreign Affairs, Culture, Engagement, Media, and Defense, and World Assembly Legislation.

Ministry of World Assembly Legislation

(15) The Minister of World Assembly Legislation will be responsible for the Coalition's activities in the World Assembly, providing assistance in drafting resolutions and issuing voting recommendations on proposals.


World Assembly Act

An act to define the World Assembly procedures of the Coalition of the South Pacific

1. Powers

(1) The Delegate shall cast their vote on proposed World Assembly resolutions according to voting recommendations issued by the Ministry of World Assembly Legislation, except under circumstances in which the Ministry issued a recommendation for the Delegate to abstain from voting. If the Ministry's recommendation is contrary to the vote of all World Assembly nations in the South Pacific, the Delegate may choose to change their vote in collaboration with the Ministry.

(2) In the absence of a recommendation, the Delegate shall vote on proposed World Assembly resolutions according to the overall vote of all World Assembly nations in the South Pacific.

(3) The Cabinet may override a vote on a proposed Security Council resolution with a simple majority but shall have no power in overriding a vote on a proposed General Assembly resolution.

2. Approval voting

(1) The Delegate may give an approval vote on proposed World Assembly resolutions freely or based on the instruction of the Minister of World Assembly Legislation.

(2) The South Pacific Special Forces are prohibited from engaging in approval raiding, except as prescribed in the Charter.

3. Voting

(1) The Ministry of World Assembly Legislation shall determine the medium for voting on proposed World Assembly resolutions.

(2) Nations of the South Pacific that are World Assembly members or members of the South Pacific Special Forces may not be barred from eligibility in having their votes counted.

(3) If a nation resigns from the World Assembly or their membership in the South Pacific Special Forces before the voting period ends, their vote shall not count.

4. Regional sovereignty

(1) The Coalition of the South Pacific reserves the right to cast its World Assembly votes without reservation or consideration of other regions.

(2) The Minister of World Assembly Legislation may work with their counterparts in other regions and the Minister of Foreign Affairs to draft and issue joint voting recommendations, but the Coalition of the South Pacific shall retain its right to vote independently of such recommendations.

5. Constitutional law

(1) The World Assembly Act is a constitutional law, and further amendments to it must meet constitutional amendment requirements.


Assembly Resolution on the Effect of the Amendment to Article VI of the Charter

A resolution postponing the establishment of the Ministry of World Assembly Legislation


The Assembly of the Coalition of the South Pacific resolves the following upon passage of the Amendment to Article VI of the Charter:

(1) The Amendment to Article VI of the Charter shall not enter into effect until the commencement of the next Cabinet elections.

(2) The Minister of World Assembly Legislation shall be elected in accordance with the Election Act and coincide with the election of all other Cabinet ministers.

I am wholly against this.

First, we don't need yet another Cabinet member that people aren't going to run for and will ultimately do nothing.

Second, this is a major infringement on the delegate in a number of ways.

Third, this is set to give a very small number of active nations a lot of power over the vote of the delegate thereby amplifying their positions over a vast majority of the region.

I doubt there will be nothing to do. After all, OWL is pretty active right now and is consistently opening votes and making recommendations.

What's more, the proposed bill is basically legislating what we have been doing since creating the OWL. If we're gonna use the argument that this will "give a very small number of active nations a lot of power", I may as well ask where that argument is when the Assembly, a group of 50–100 people, makes decisions on the behalf of the whole region. There is nothing in this bill that gives some sort of almighty power to a small cabal. Anyone with a WA nation in TSP or serving in the SPSF would have the right to cast a vote but a number of those people choose not to exercise that right.

Control of the regional WA vote is asigined to the Delegate by the game; creating another elected official to tell the Delegate how to vote is the height of absurdity when we already elect someone to have that responsibility.

This argument makes no sense. If we follow this logic, then we should abolish the endorsement cap, let someone seize the delegacy, and rule as they see fit. Obviously, we aren't gonna do that. I don't know if you know this, but what is being legislated has been the status quo since the OWL was created, which is the second time I've said that in this thread. We're long gone from the days that the delegate has absolute power because we have since created a strong PM/Cabinet by taking away the delegate's de jure executive power. Furthermore, what is being legislated is nothing different from the activities of other regions such as TNP, TRR, XKI, TEP, and so many other regions, which is the democratization of the delegate's vote. Have we forgotten that we've made the delegate a figurehead in this region?

I fully support this bill. It is important there is a dedicated Minister for World Assembly Affairs with a fully fledged regional government department as it will reduce the Delegate's still sizeable workload further and will provide greater legal autonomy for OWL.

Every single WA Delegate has a sacred duty to represent the views of the majority of their regional WA members except if the majority's views are against the broader values of the region. The WA Delegate does not have a god given right to vote in a manner which is contrary to the overwhelming views of the region. As arguably the most purely democratic region in the game, the South Pacific's commitment to ensuring that the Delegate votes according to how the region wants them to vote should be continued.

The biggest problem with making it an elected position right now is to find candidates for the position. If OWL has a good base of people who want to run for the position then this is a good proposal. But with this becoming a ministry or not, we still have to restrict the Delegate's legal freedom to decide on GA and SC resolutions. Currently, the Delegate can easily and legally ignore Cabinet's recommendations on any SC or GA resolution, this has not happened yet, but there is nothing to assure it won't happen in the future. The view that the Delegate *is* 100% responsible for WA voting decision indicated by certain legislators violates the principle that they should only serve as a head of state.
