[PASSED] Nomination of Roavin to the High Court |
I fail to see why we would ever need an Attorney General.

Given the non-adversarial nature of our judiciary, I don't see the necessity of an Attorney General in our system. Well, in case of a rogue Delegate, I'll be most involved in my capacity as General in fighting tooth and nail against that. My position as Justice wouldn't matter much in that particular moment. That being said, such an emergency would certainly lead to multiple court cases being filed that I would likely be involved in, and some of those may require injunctions. I don't see the need for me to change my approach as justice in this case as a rogue Delegate is ipso facto illegal. Why or why not? How can justices meet community expectations in sentencing whilst also ensuring that sentences are fair, just and proportionate to the offence committed? Without commenting on the specifics of Python's proposals, I do support creating sentencing guidelines - not hard rules, but general principles to follow in determining a just sentence. Without sentencing guidelines, it comes down to (once again) considering context and precedent and (of course) the specifics of the case. Taking the example of 2012.HC, had Philippinia not refused the Court's (reasonable) requests, I can imagine that the final judgement would rather have been a slap on the wrist rather than what it was. I like that the High Court offers its proposed sentences beforehand so that the community can comment on them. That helps to make sure they are reasonable.
