Brief: Amending the terminology applied in a law

Relevant legislation: Elections Act & Judicial Act

Proposal: Currently, section 7 of the Elections Act stipulates that:

7. Separation of Powers Wrote:(1) Offices of the Coalition are the Delegate, the Prime Minister and Cabinet Ministers, the Chair of the Assembly, Local Councillors, the Permanent Justice, and any of their appointed deputies.

In light of the Judicial Act having reorganised the judiciary to comprise of the Chief Justice and two Associate Justices, section 7 should be revised to reflect the current position of the Chief Justice.

Proposed amendment Wrote:(1) Offices of the Coalition are the Delegate, the Prime Minister and Cabinet Ministers, the Chair of the Assembly, Local Councillors, the Permanent Justice Chief Justice, and any of their appointed deputies.

As the Elections Act is a constitutional law, this amendment shall require a three-fifths supermajority to pass.

Relevant legislation: Regional Communications Act & Judicial Act

Proposal: Currently, section 3 of the Regional Communications Act stipulates that:

3. Infractions Wrote:(1) Infractions may be brought before the Permanent Justice in a court case. For the duration of the court proceedings, the Delegate may suspend the mass communication capabilities of the accused.

In light of the Judicial Act having reorganised the judiciary to comprise of the Chief Justice and at least two Associate Justices, section 3 should be revised to reflect the High Court as a whole.

Proposed amendment Wrote:(1) Infractions may be brought before the Permanent Justice High Court in a court case. For the duration of the court proceedings, the Delegate may suspend the mass communication capabilities of the accused.

Relevant legislation: Criminal Code & Judicial Act

Proposal: Currently, section 3 (1)(a.) of the Criminal Code stipulates that:

3. Parole Wrote:(1) After serving at least one year of a ban from the region and/or the regional forum, convicts may apply for parole to a parole board.
a. Said parole board shall consist of the senior most member of the Council on Regional Security, the Permanent Justice of the High Court, and the Chair of the Assembly.

In light of the Judicial Act having reorganised the judiciary to comprise of the Chief Justice and at least two Associate Justices, section 3 should be revised to reflect the current position of the Chief Justice.

I'm don't believe so. As Associate Justice is not a position explicitly firewalled, it would inconsistent to do so here.

Edit: For the record, an amendment to address this exact issue was proposed last month by Awe. There were disagreements as to whether it should include 'Justices of the High Court' or just the 'Chief Justice'. It did not go to a vote.

I agree with all of your changes. One could make an argument for recusals for the Parole act, but given that it also explicitly requires the senior-most CRS member, I'm fine with it as-is.
