[DRAFT] [2237.AB] Assembly approval of the Election Commissioner

It also allows the Assembly to reject an Election Commissioner for any reason, even if that reason is unjust, or without a reason at all.

So yeah, maybe let's agree to disagree. Because frankly, you aren't actually addressing many of the concerns that have been raised — it isn't making it particularly easy to agree with you on this amendment.

Wait, but couldn't the Assembly recall an EC, even if that reason is unjust, or lacking a substantial reason?

A Legislator could initiate recall against the Election Commissioner, but if the reasoning is unjust, without substantial backing, or otherwise "bad", I would imagine the Assembly would recognize the measure as such and either not bring it to vote or vote in opposition.

The Elections Act clearly states, "The Assembly may recall a Commissioner for abuse of power or neglect of responsibilities through regular order."

I voted against these, but to add to the other voices, the problem with having the Assembly vote is that it takes significant time to hold the vote, so if someone like Kris isn't going to hold it for a long time we run into timing issues.
