[DISCUSSION] Criminal Code Amendment
#1

Apparently, Article 4 (Prohibited Regions and Organizations) is still on the books, despite having been superseded by the Proscription Act. We can just remove that portion entirely, I'd say.

I quite like that Prohibited Regions require Assembly approval. It could be amended to give a stronger alternative to proscription, perhaps?

I'd prefer amending that into the Proscription Act, then, to keep stuff together.

Only if the Empire’s proscription is untouched.

The CRS can just decree that at any time with extant law.

Not without a new full report to the Assembly, the entirety of which will fall on me, and the ensuing trials and court cases the Proscription Act attracts.

The Empire prohibition is long settled. So I have no choice but to oppose repealing this part of the law unless that prohibition is grandfathered in.

Bleh.

Who would be the issuing authority?

Considering that we've been issuing proscriptions and not prohibited groups, I am in favour of this proposal.

If this passes, though, we need to notify the High Court on what to do with the Empire. I personally I haven't heard of it, and if has done anything serious to TSP, it's been quite some time.

It would be a simple resolution:

“The extant prohibition of the Empire is grandfathered under the terms with which it was issued.”

The Cabinet issued the prohibition, and the Assembly approved it. (Twice btw.) To repeal, we would use the process that exists under the then-repealed law. But no other future proscriptions/prohibitions will use this law. That’s how grandfathering usually works IRL.

@Sal: Empire hasn’t done anything in TSP because we’ve banned them from participating for years. They were involved in a coup of TSP, and have a long history of infiltrating and subverting many regions.

I see. I support your grandfathering idea; it's simple and effective.
