Government positions

Recently, GR asked the High Court to explore whether members could hold both a deputy position in the Cabinet and also a senior cabinet and/or judicial position at the same time.

The Court -- unable to come to a decision -- referred the matter back to the Assembly.We should probably clarify the situation.

Thoughts?

I think the intent of the Assembly is pretty clear to me, to create a firewall between the Cabinet and the judiciary and to prevent too much centralization within the Cabinet itself. We should just clean up the wording:

Quote:6. No one can run for or hold more than one Cabinet position, or more than one Justice position, or both a Cabinet and a Justice position at any given time.

In my opinion it is to prevent anyone person from holding two or more elected positions.

Considering the deputy position is mostly a gesture of good faith, and to help the minister, I see no problem with a justice or a cabinet minister serving appointed positions.

The issue is that a deputy is a full-fledged member of the Cabinet and influences executive decisions. They have access to everything but the Situation Room forum. So there's an inherent conflict of interest when a deputy is also a justice. The same conflict of interest that exists if somebody's a Minister and a justice.

The Judiciary and Executive must remain seperate, otherwise there is an increased threat that one becomes the tool of the other

The positions should remain separate for the reasons stated and also to ensure that we can get more/new people involved

I say nay myself. But then that is because of the issure brought up by Ditortilla.

Ditortilla (presumably) supports the amendment, because the executive and the judiciary should be separate, "otherwise there is an increased threat that one becomes the tool of the other."

So what are you saying "nay" to? Allowing people to hold a Cabinet and a justice position at the same time, or banning that? Huh

There is no reason why the two posts should be held by one person, given that we have enough people to carry out all functions in TSP.
