VOTE: Chair Reform

The following is a proposal to amend the Charter and Election Act. Voting will remain open for 5 days and requires 75% approval to pass.
 
This proposal removes the CoA from the Cabinet. The debate can be found here.
 
Quote:Section 2 - Chair of the Assembly and Duties of the Chair.
1. The Assembly will elect a Chair which will be responsible for the administration of all aspects of the drafting, debate, and passage of legislation.
2. The Chair of the Assembly has the clerical duty to maintain the Charter, Code of Laws, and all subsidiary documents, ensuring that all laws comport with proper standards and formatting, and all minor changes made are publicly recorded.
3. The Chair of the Assembly will serve on the Cabinet and act as the Legislative Liaison between the Cabinet and Assembly.
3. The Chair will serve a term lasting four months.
4. Procedures for the election of the Chair must be defined in Code of Laws.
 
Section 1 - Cabinet and Powers of the Cabinet
1. The Cabinet shall consist of senior and junior members.
2. The senior Cabinet members shall be the Delegate, Vice Delegate, Minister of Foreign Affairs, Minster of Regional Affairs, and Minister of the Army, and Chair of the Assembly.
3. The junior Cabinet members shall be all appointed Deputies.
4. Senior members of the cabinet are the only members with voting rights within the Cabinet.
5. The Cabinet shall strive to promote activity in the region and shall remain cognizant of the well-being of all nations in the Coalition of the South Pacific.
6. The Cabinet may adopt Executive Policy in cases where no law exists; Executive Policy may not conflict with the Charter, Bill of Rights, or Code of Law.
7. The Cabinet will serve a term lasting four months, excepting appointed Cabinet Deputies, who serve at the discretion of their respective Senior Cabinet member.
8. Procedures for the election of the senior Cabinet must be defined in the Code of Laws.

[b]Article 1 - General Elections[/b]

1. Elections for all Cabinet positions and the Chair of the Assembly shall commence on the fifteenth of every March, July, and November.
2. Elections for Court Justices shall commence on the first of every April, August, and December.
3. Elections for Local Councillors shall commence on the first of every May, September, and January.
4. Terms for all Cabinet positions and the Chair of the Assembly shall commence on the first of every April, August, and December; terms for Justices shall commence on the fifteenth of every April, August, and December, while terms for Local Councillors on the fifteenth of every June, September, and January.
5. All elections shall consist of a pre-voting period lasting six days and a voting period lasting three days. Citizens shall have to declare their candidacy or accept their nomination within the first three days of the pre-voting period.
6. No one can run for or hold more than one Cabinet position, or more than one Justice position, or more than one Local Council position or both a Cabinet, Justice or Local Council position at any given time.
7. Candidates for elections may self-declare or be nominated by another Citizen. Candidates must file a Conflict of Interest Disclosure at the time of their acceptance of a nomination or self-declaration.
8. Nominations may be accepted in absentia, as long as they are sent to the Election Commissioner at most two weeks before the start of the pre-voting period, and include a Conflict of Interest disclosure.
9. Conflict of Interest Disclosures must include current World Assembly Nation, all past and present aliases used, all past and present involvement in other regions and organizations, and all current positions held across NationStates.

Article 2 - Position Specificities

1. The Delegate and Vice Delegate will run on a joint ticket.
2. Cabinet offices and the Chair of the Assembly will be voted on separately.
3. Voters during Cabinet and Chair of the Assembly Elections shall list all candidates from their most to least preferred on their ballot.
4. The winning candidates during a Cabinet and Chair of the Assembly Election race shall be the candidate, when paired up against any other candidate, who would surpass any other candidate in terms of support; if no such candidate exists, the winning candidate shall be determined by an instant-runoff vote. In the event of a tie the election for that office will be restarted immediately.
5. Court Justices will be voted through a single ballot, with the four candidates who receive the most votes winning seats.
6. In all elections an option to re-open nominations will be included. For non-judicial elections, if this option receives the most votes the nomination period for that office will be restarted.
7. For Local Council elections, at least one resident must express their support for the nomination of every recognized candidate. Voting for the Local Council shall take place through a regional poll open to all 'native' WA residents. The Local Council will be voted through a single ballot, with the three candidates who receive the most votes winning seats.
8. In the event that more than ten candidates run for the Local Council, the list of candidates shall be divided evenly and randomly as possible in brackets of under eleven candidates each - and the top candidates shall compete as Section 2.4 suggests in a final round of selections. The number of candidates from each bracket which advance to the final round of voting shall be proportional to 10 / (# of Brackets + 1).
9. For Court Justice and Local Council elections, if the option to Re-Open Nominations receives enough votes to be placed within the winning selection, then the nomination period will be restarted for all seats with lesser votes than this option. The candidates who receive the top votes will win however many seats are left to be filled.
