The incoming CoA could approve this retroactively, though that's a grey area at best.
So Am I allowed a LoA or not?
Unless you're running for CoA or going for CRS, even if the procedural issue isn't worked out and you lose the status for a few days, no harm is done and reapplying should be a formality.
Though personally, I think the incoming chair (whoever it will be) should just grant it retroactively.
