CRS Statement on the Activation of Section 1(1) of the Security Powers Act
#11

(04-05-2017, 10:34 AM)Kris Kringle Wrote: I think this will be a good opportunity for both side to approach this issue with good faith and renewed confidence, and work together to ensure this investigation reaches its logical conclusion in the best way possible. I can tell you that my agenda is merely to find the truth, whether that means taking further punitive action or lifting the restrictions. If we can work together to accomplish that goal, I think this will prove that the process works.

Which is something I support and have no problem with. I have being trying for weeks to cooperate as fully as possible, and have no objection to this investigation - though I think there is no question that it has been handled extremely badly. But, at the end of the day, due process means that if there is no evidence that I have broken the law the CRS must acknowledge this.

The SPA is not a replacement for our judicial system, nor is the CRS allowed to ignore the bill of rights.

I don't think anyone wants to ignore the Bill of Rights. If a violation happens, we have a Court to handle that, and the affected party can and should raise the matter there. The only way to strengthen our judiciary is to actually use it when we feel it's needed.

Which isn't an objective served by substituting a nebulous and extra-judicial "security" process for a criminal trial, when making criminal allegations.

I think this process is needed, but like all security actions, its use should be rare and solemn.

I would agree that the a process like this is needed, which is why I didn't vote against the SPA. But it needs to be handled carefully and within strict, and can't become a substitute for due process.

I'm sure it won't.

Is that an assurance that should the CRS conclude that there is evidence that I have committed a crime - as has been alleged - then they will press criminal charges? I ask because I've acquired the opposite impression.

I'm not sure you have been accused of any crime. I know that we will explore all proper legal avenues, should we find you to be in the wrong, after the investigation has been adequately concluded.

I have been accused of actions equating to at least four different crimes; I think the fact that the CRS hasn't formally used the exact wording is a semantic issue.

We'll take one issue at a time. First, let's ensure the investigation is properly conducted.
