Potential Withdraw from The January Accords
#21

To be clear, again, I'm not condoning the language nor the rhetoric nor thing we should do it here. But, what I mean by activity isn't a relative activity to the population — it reads to me like Fedele is trying to get people to "Marsupial hunt" which would be the activity. Sometimes people do ugly things to spur NS activity (see the idea of "Raiding" writ large).

All said, Glen's point is salient. The action is breaking the current laws in TEP and that's what we should lean into and be worried about.

I knew these actions were breaking some laws, because a few days ago I discovered that their Concordat, i.e. their constitution, says:
Concordat Wrote:Article A: Executive
...
Section 3) The Delegate shall eject and/or banish nations from the region members who have committed a summary offense or have been convicted of an indictable offense by the Conclave, for a prescribed period of time. [2014 Am 2, §1]

This is the only time that banishment is mentioned in the Concordat, let alone sanctioned by the Delegate. Now, if the "marsupials" were to have been charged with a summary or indictable offense, then the banning would be legal, but according to their Codicis, i.e. their list of laws, they wouldn't fit any crime. The Codicis also clearly shows that the East Pacific's forum laws also apply to gameside as well. I also checked and it appears that the Delegate does not have the power to pass laws on their own. All of this leads to the conclusion that the actions of the delegate are unconstitutional.

I'd like to note a few more things:
Concordat Wrote:Article C: Judicial
...
Section 5) The Conclave may rule on the actions of the Delegate or laws passed by the Magisterium and nullify and prohibit any which are contrary to this Concordat.
...
Article F: Rights of Citizens
...
Section 3) Each citizen shall have the right to a swift and impartial trial by the Conclave if action is taken against them by the regional authorities.

Since the actions of the delegate are unconstitutional, the Conclave, i.e. the High Court, has the power to nullify the actions of the delegate. The "marsupials" banned by the delegate also have the right to a fair trial by the Conclave, and again since they aren't guilty of any crimes, they should be unbanned.

Oh, I am by no means taking issue with your viewpoint. I apologise if that seemed to be the case at all.

Separate from the immediate political ramifications of recent developments in TEP, I am, personally, surprised that people in the gameplay sphere who would otherwise deplore fascism and support R/D efforts against it have publicly said little to nothing to dissuade the powers that be to move away from using such historically charged language. Regardless, that is simply a personal position of mine and I will speak no more of it. It's just a curiosity of mine.

I mean, TEPers basically accept that what the Fedele admin is doing is illegal. They just don’t care. In their view of things, these nations are useless and no one has bothered to take them to court over it, so what’s the big deal?

If no one speaks on it - what’s to stop others from trying it too?

I went through TEP's legislature, and found a couple troubling things, such as:

Fedele offering to get rid of the judicial system
Fedele arguing against term limits for the Delegate, probably because he wants to be Delegate forever...
Fedele making someone a position for life, that has term limits and oversees elections

This, coupled with the marsupial rhetoric and the fact that Tim, someone banned from our region for harassment, is his right hand man, concerns me.

It's clear that TEP is entering the road to dictatorship again. As much as I would want to support a democratic coup, it goes against values we have as a defender region.

Could we possibly send out an invitation for all those displaced to come here if they want? Even if they are on the verge of CTEing, is it possible?

Possible, but thats very risky since its technically recruiting, and massively frowned upon. Especially if those nations were already ejected to TRR, with whom we have multiple treaties... (its been a while since Ive read them, but I assume it'd be against the terms of at least one of the 2)

I guess that means we have to know how TRR feels about this situation and what they think.
