From the end of January, I will have a lot of unpaid placement on top of university study. As such, I will not have sufficient time to carry out the duties of a Justice of the High Court of the South Pacific. While I did consider asking for Senior status, I concluded that a clean break would be in my best interests. Hence, I intend to resign.
Since there are about two months until I actually shall have to go, I am happy to stay on as a Justice until a replacement is appointed so as to avoid overloading the current bench. If there are no objections to this, I will inform the Cabinet that this is my intention. It has been a pleasure to serve on the Court. Thank you for being wonderful colleagues.

I am sad to see you go, but regardless thank you for your service from the bench. I think delaying your actual resignation until we decide if a new Justice is needed, and if so then who will be appointed, would be the best move.
I think there is a benefit to having 4 Justices, one of whom is on Senior Status, so I'd favour starting the application process. @ Belschaft and @ Griffindor, what are your thoughts on this matter?

It has been a pleasure working with you these last several months, Nat. Your legal reasoning, analysis, and writing are as sharp as ever, and something I will strive to get to (and surpass ). I hope we will one day see you back on the court. Good luck with your university work!
In regards to a replacement Justice, I agree that 4 Justices is a good setup and gave the Court much-needed flexibility for handling cases. I would also be in favor to open the application process.

Very sad to see you go Nat, but best of luck with your placements.
I agree that having four justices has been helpful and we should ask the Cabinet to conduct an application process for a replacement, but if there aren't any qualified candidates we can remain with three instead.

I agree. I'll reach out to the Prime Minister to tell them the news, but clarifying that our priority is quality over quantity.
@ Nat, would you like to announce your intent to resign before we open applications, or would you prefer to have a new Justice in place before announcing? I ask mainly to know if the call for applications should (or shouldn't) mention anything about your retirement.

Thank you all for your kind words. I would like to publicly announce my intent to resign before the application process begins. I intend to do so once Cabinet is informed and is on board. I have sent a resignation letter to the Prime Minister via private message and have copied the Chief Justice in.

I understand that this is also the wish of the Court (though the Chief Justice may wish to clarify this with the Cabinet). If there are no objections from Cabinet, I will continue to serve until a replacement is installed.
It would be greatly appreciated if you could bring this letter before Cabinet and could also convey their response back to me. I trust that the Cabinet will not make details of my impending resignation public until I have had a chance to make a formal press release. I intend to make a public statement soon after the Cabinet has confirmed they are happy to proceed (i.e. before the application process begins).
Thank you in advance for your consideration and assistance in this matter.

Thank you for informing me. I have passed it on to the Cabinet and when you are ready to resign, please let us know.
I hope that you have awesometastic luck in whatever you do next!

Nat to CJ; 2 Dec 2020 Wrote:Below is the reply I received from the PM. As it was very non-specific, I have sent a reply checking whether the Cabinet wants to appoint a replacement in the next two months (in which case I will publicly announce my resignation soon) or after I am gone (in which case I will publicly announce my resignation later). I have copied you into that reply - Nat.

Thank you for informing the Cabinet of my intention to resign. Thank you also for the kind words in your reply to me.
If the Cabinet is satisfied, my resignation will be announced soon but will be effective from 31 January 2021 (i.e. I will say that I will leave at the end of January). This will allow the appointment process to occur over the next two months so that hopefully a replacement will be selected by the time I leave the bench. My understanding is that the Court would prefer this approach, as it means that there will not be a vacant seat while Cabinet calls for and considers applications.
I appreciate that this is not the usual way of doing things and will respect the final decision of the Cabinet on whether to approach the upcoming vacancy in this way. Notwithstanding this, it would be appreciated if you could indicate whether the Cabinet is happy to proceed in the manner described above. This is because there is no advantage to me announcing my resignation early unless Cabinet will avail itself of the opportunity to begin the application process this month.
Thank you again for your consideration and assistance in this matter.

Justice Nat

P.S. I have again copied the Chief Justice into this correspondence. For completeness, I have sent him your reply to me. I trust this was fine to do.

I'm sure you have considered this but just out of an abundance of caution, I understand that you would announce your intent to resign soon but would separately submit your actual resignation only on 30 January 2021? I ask because I'd like to avoid any risk of ambiguity on when your resignation would take effect if it was submitted with a delayed effect, as opposed to announced early but only submitted on the actual date.

I had not considered that. Thank you for bringing it up. Based on your suggestion, I think announcing an intention to resign (as opposed to a deferred resignation) is the wisest path forward. Provided such an approach is acceptable to Cabinet, I will do it as you suggested.

Nat
P.S. I have copied the PM in.

And so far I have not received any replies in regards to your announcement. I will be posting the second portion today but I don't see any reason why there would be any issues with it. Announcing your intention with a Valid date is very responsible and I appreciate it.

Thank you for your message. I was wondering whether the Cabinet would be happy if I publicly release the following statement or if they would prefer that I wait until a more opportune time. I am asking with specific regard to the bolded portion of the draft below.
An increased workload at university means that it is not wise for me to continue on the Court in the coming year. As such, I intend to resign at or around the end of January. While this announcement does not constitute a formal resignation, it has been provided so that the Cabinet may begin the process of appointing a replacement if they so choose. For the avoidance of any doubt, I will continue in my current role as a Justice until I formally resign at the end of January. I have thoroughly enjoyed my time on the Court and wish my judicial colleagues all the best with their important work.
Thank you in advance for your consideration and assistance.

Given the Prime Minister's response, are you happy if I publicly post my announcement now or do you think I should wait until the criminal case is concluded? I don't think there is a reason to wait (since it makes it clear I will be leaving in January and not now), but am happy to wait if you feel it is wise. A draft of the announcement is provided below for your reference.
Kind regards,
Nat

Given Roavin's nomination is being considered by the Assembly and I have no more cases to discharge, I intend on formally resigning in the next day or two. Please let me know if there will be any issues with this. It has been a lovely time working with you all on the Court, and I wish you all the best

I think Roavin will have some pretty big shoes to fill. It has been a real pleasure working alongside you on the Court and I hope you have an opportunity to join us again at some point in the future. Either way, best of luck in your future endeavours!
