The sky is blue because that's how the renovation was planned 4 billion years ago. I guess red wasn't in fashion before.

@Kris Kringle:
The Court has taken the colour of the sky into consideration. In view of the measured frequency response of light sourced from the direction of a regular noon sky, regardless of initial origin of the photons that were measured, the Court will recognize the sky to be blue via judicial notice.
