Charter Typo
#71

There is a reason why we have an Appellate Court. Instead of wasting our time with endless discussions about why the ruling was wrong, how about you guys use the proper channels for at least once in the history of this region? In fact, let me help you with that: http://thesouthpacific.x10.mx/newthread.php?fid=45

Posts outside High Court venues should be taken as those of any other legislator.
I do not participate in the regional server, but I am happy to talk through instant messaging or on the forum.

I doubt HEM would rule any different, Kris. Nor does the appeals process mean I'm not going to criticize what I see as a bad ruling by the High Court.

Let's just pass an amendment and put this behind us.

...'Cause an amendment is obviously gonna pass.

If we want the Chair to be able to fix typos, we have no choice. The High Court's decision has been could be appealed, but I doubt HEM will disagree with the High Court's literalist views of law.

That amendment in particular was also very bureaucratic. I voted against it for that reason, in addition to the belief that an amendment was unnecessary. I'm sure others voted against or abstained for similar reasons.

I again propose this amendment:

Quote:Section 2 - Chair of the Assembly and Duties of the Chair.
X. The Chair of the Assembly has the clerical duty to maintain the Charter, Code of Laws, and all subsidiary documents, ensuring that all laws comport with proper standards and formatting, and all minor changes made are publicly recorded.

I motion the amendment to a vote.

No -- this is not how this is going to work.

Bels -- you do not get to get to issue a ruling and then come here to declare GR's previous actions "staggeringly illegal." You cannot make something retroactively illegal.

GR -- despite what each of us individually think, now that the issue is decided by the courts, we must follow their decision. We can either legislate it to give the CoA the powers or abide by the law as the court has decided.

If we can't continue this discussion civilly, we'll end this decision completely. This is the only warning I'm giving.

@tsu: I'm not advocating ignoring the High Court's decision. I'm criticizing it as a bad decision. We now have to amend the Charter just to let you fix typos.

I second this motion.

Considering the significance of this discussion, I'm going to request that the drafter adds this to Article 3, Section 2 -- with correct numbering. We don't want a question of which part of the section it is.

Once an appropriate draft is posted, motioned and seconded, I'll put it up for a vote.

A simple thread with a post " Below is an amendment to change the charter/COL to correct typos" with the edited post, would have got seconded, voted on and done a week ago. We really don't need more legislation.

Section 2 - Chair of the Assembly and Duties of the Chair.

1. The Assembly will elect a Chair which will be responsible for the administration of all aspects of the drafting, debate, and passage of legislation.
2. The Chair of the Assembly has the clerical duty to maintain the Charter, Code of Laws, and all subsidiary documents, ensuring that all laws comport with proper standards and formatting, and all minor changes made are publicly recorded.
3. The Chair of the Assembly will serve on the Cabinet and act as the Legislative Liaison between the Cabinet and Assembly.
4. The Chair will serve a term lasting four months.
5. Procedures for the election of the Chair must be defined in Code of Laws.

----

Though, of course, you'd be able to do the formatting yourself if this is passed. Tounge

Motion to vote.
