[PASSED] Nomination of Phoenix to the Legislator Committee
#31

I will be voting Nay, as whilst Phoenix is undoubtably qualified I do not believe the Cabinet should nominate one of their own members to the Legislator Committee.

Bel, the cabinet already talked about this, Pheonix was who Nakari recommended as her replacement when she resigned from LegCom.

Which has no effect on the underlying principle.

I think the more relevant question might be whether or not Phoenix plans to run again in the Oct. elections?

Phoenix has shown her intention to run again.
We discussed this matter with the Cabinet and our advisors - they determined the fact that she's in the Cabinet not to be a problem.

It is not legally prohibited, but that does not make it appropriate.

Then who would you have appointed?

There are many qualified legislators who are not serving Cabinet members.

In fact, there were originally two candidates brought to the Assembly. The other candidate being someone not currently in Cabinet, if I recall correctly.

We discussed this matter with the Cabinet and our advisors - they determined the fact that she's in the Cabinet not to be a problem.

So, at the risk of coming off as rude, I'm more of less indifferent to this appointment. However, I'm a tad bothered by the fact that the Cabinet is like "Eh -- no bigs! We all think its fine."

We can make own our decisions about the appropriateness of the appointment, but I do think Bel raises a v. real concern. LegCom are the people who decide who can and cannot be a legislator, thereby they are the group that largely determines the voter pool. This has nothing to do with Phoenix's individual qualifications for the role (nor Nakari's recommendation), but does have to do with appearances of impropriety and potentially a real conflict of interest — as Bel has noted.

Has the Cabinet given any thought to this?
Or would the Cabinet like to give some thought to this?
Would the Cabinet care to elaborate on why it and its advisors thought this wasn't a problem?

Frankly, I'm disappointed in that neither the Cabinet nor this body is taking Bel's contention seriously. It may not be disqualifying (and based on the vote won't be disqualifying), but we all deserve a better explanation of the decision-making process than we've received.
