Sunshine Act Compliance - January 2021

I've made a list of all things which are due for release under the Sunshine Act until February. I think we should release them all. The whole Local Council elections saga is not due for release until late March due to the appeal: 'For a High Court case, they shall be released no later than 6 months after the ruling or, if appealed, the ruling on the appeal, has been announced.' (Sunshine Act 2.2b).

Here is a list of threads which were completed by November; while none of them are due for release yet, it has been at least two months since the cases were published and so I am in favour of releasing them as well (however, I understand if others are not):

Also, the old High Court DM group last had a post on 8 May 2020, meaning that the entire log ought to be released. The Roa & The Court DM group (last post 17 Aug 2020) would be due for release in February. Additionally, up until Belschaft posted on 7-8 Jan 2021, the #court-confrence-room last had a post on 28 Oct 2020 (so depending on the parameters, is either due for a partial or near-full release of current stuff). If others are happy to consider their release, I can go through those ones and double-check there is nothing problematic in them.

Anyway, I thought I would get the ball rolling on this as getting the Court up-to-date with the Sunshine Act is something I am hoping to do before I depart  Smile

No objections to releasing the threads due for release.

Are you sure the dates of the second table are correct? I'm not sure 2010.HQ would only be due for release in November 2021. In any case, I would be willing to hear arguments in favour of releasing threads due to release before, say, March 15, but those due after that do seem a bit too far away yet.

Just for the record, the Sunshine Act only requires government institutions to release discussions that lead to decisions outside working areas. I say this not to imply that we shouldn't release the contents of channels, rather to point out that releasing real time coordinations, most of which amount to "please check this thread", should come only after we release actual threads and only if not overly burdensome.

I don't have any objections to the threads in the first table is released. Nor do I have an issue with any threads in the second table being released before the rough March 15th date. I don't think it would hurt to release the WI threads either; keeping the threads classified serves little use since nothing of substance happened in them.

Kris, did you do any further work on the formatting thread (https://tspforums.xyz/thread-8519.html) (mostly in terms of developing the code for it)? This is the first time I have seen that thread since its original conversation, and would not want to see it released if we come back to it.

I am also in favor of releasing any logs in the various group chats and channels. I think the New Year would be a good stopping place for that since, as Nat said, the only post since the New Year was Bel's a week ago.

I'd be fine with the release of anything relating to closed cases personally, as once we're done with a case there is no reason to keep it private.

Good pick up, it was meant to be May 2021. Sorry about that.

Regarding the Discord chat, sometimes a level of substantial discussion goes on there (and is not put on the forum). No decisions, but things such as clarifying particular points. I think there is nothing to lose if we make it public. I am happy to go through them a provide a draft release for our consideration.

I agree with Belschaft that all closed cases should be released as I see no real reason to keep them private. It would also useful because otherwise we get behind on the Sunshine Act-required releases (e.g. we are a month-and-a-half behind now, despite doing a release last July). Nonetheless, if both Griffindor and Kris wish to keep more to a six-month schedule then I am happy with Griffindor's plan to release all the threads up to and including the Whole India ones. This does mean the Court will have to revisit the Sunshine Act in late March though.

Regarding the standardised formatting thread, I am happy to keep that here since there are plans to revisit it.

What qualifies as a “closed case” though? If we won’t adhered to the 6 months of the Sunshine Act then we need a standard amount of time that will need to have passed before we release case threads, and ideally I wouldn’t want it to be mere days or weeks.

I don't have much of a preference for how long we hold cases, but I don't think they should be released for at least a couple of months after a case.

I also think that it would be beneficial to begin a January/July (or any other two months) release batch (though that would need an amendment to the SA).

My original interpretation of the SA led me to believe that if we did two batches some of the cases would be over the maximum length of time for case release, then I recalled that we could release before the six months were up so it wouldn’t be an issue. Disregard my last post Tounge
