A resolution to form an international anti-criminal organisation

A resolution proposed by Ambassador Marcus Bailey of the Valkyrian Republic.

Section A — Introduction
  • To maintain greater security and order, we hereby establish the International Anti-Criminal Organisation.
Section B — Terms
  • Genocide — the deliberate killing of a large group of people, especially those of a particular ethnic group or nation
  • IACO (pronounced ee-ah-ko) — International Anti-Criminal Organisation
  • Incoming state — State that issued the World Arrest Warrant
  • Outgoing state — State that holds the subject or subjects of the World Arrest Warrant
  • WAW — World Arrest Warrant
Section C — Mandate
  • IACO shall
    • Be an international organisation featuring the voluntary membership of states within the World Forum,
    • Help facilitate the legal extradition of criminals from one state to another, and
    • Assist in bringing violators of international law before the International Court.
Section D — Responsibilities of the Assembly
  • The Assembly shall be responsible to pass resolutions to:
    • Define the crimes that shall exist under the scope of IACO and
    • Define what constitutes a crime against humanity or war crime in addition to the provisions of the Grovne Convention.
Section E — World Arrest Warrant
  • A member state may issue a World Arrest Warrant against a person for any crime under the scope of IACO.
  • All outgoing states of IACO shall be obligated to comply with the WAW and extradite an individual or individuals to the incoming state.
  • When the offences committed are genocide, crimes against humanity, or war crimes, outgoing states shall transfer the custody of individuals to IACO.
  • An outgoing state shall be able to refuse to recognise a WAW if:
    • The incoming state practises capital punishment or life imprisonment,
    • The subject or subjects of the WAW are below the age of criminal responsibility in the outgoing state, or
    • The crime that took place within the incoming state is not recognised as a crime in the outgoing state
  • The validity of a WAW may be challenged by any member state of IACO and can be nullified by a simple majority vote among the member states of IACO.
Section F — Enforcement
  • Any member state of IACO may volunteer their correctional facilities as venues to hold individuals convicted of violating international law.
  • Member states of IACO that fail to act on a valid WAW may be suspended or expelled by a simple majority vote among other member states of IACO.
Section G — Organisational structure
  • IACO shall be headed by a director-general who shall be elected by a simple majority vote in the Committee for International Law.
  • The director-general shall serve for a term of six months.
  • The Committee for International Law shall determine, by a simple majority vote, the headquarters of IACO.

(An OOC note though: I've always assumed that many of the RL conventions and standards exist here, including crime against humanity or war crime. Perhaps we could make the Grovne Convention canon, and write any convention from it into the scope of the IACO?)

(OOC: I have added the Grovne Convention to the resolution. To be honest, I did not know that existed until now. By the way, how do you pronounce Grovne? I've never gotten around to asking that.)

"As long as these criminals are subject to our laws, we don't see why we shouldn't agree with the proposal by the speaker. We hope that the IACO could however, respect the national police and the laws of the state before acting on its own. We also want to say that this body must cooperate with Interpol as well, noting the fact that the criminals are international."

(OOC: Well, that RP did not really take off, but if we can agree that the Grovne Convention happened (i.e. more or less the Geneva Convention), it would save a lot of time and work.

You pronounce Grovne like ['gru:vn̪e] if you can read the IPA (hope the special characters work here).

An approximation in English would be Groov-ne, but where the r is rolled and the e is more or less pronounced like the e in bed. So kinda like the English word groove + n + short e.)

[OOC: @Hammerstar, to my understanding, there was no Interpol in RP. If there is, IACO will assume many of the responsibilities of Interpol.]

"While the Empire respects the effort to promote regional cooperation to fight crime, we have concerns about this organization in terms of its place within a member state. In particular its relationship with local law enforcement and how the organization intends to reconcile the differing laws of each member state."

As currently written, IACO will not have a direct relationship with local law enforcement agencies. Instead, local law enforcement agencies will need the national government to file a World Arrest Warrant. As for your second concern, Sections D and E cover the differing laws problem. With Section D, crimes such as murder or rape can be universally recognised. With Section E, a member state that does not criminalise cannabis consumption can refuse to recognise the World Arrest Warrant of another state that does criminalise it. The purposes of the "refuse to recognise" and "validity" clauses are to take into account the differences in the laws of the state and so that states will not be able to abuse this system to persecute individuals who oppose the current regime of a state.
