SEPTEMBER 2022 CHAIR OF THE ASSEMBLY ELECTION
DECLARATIONS OF CANDIDACY

The election will consist of a single round of voting where legislators may list the candidates whom they approve without regard to any order of preference. The candidate who has a majority of approvals will be the winner, else the election shall revert to the declarations period. Please consult the Elections Act for the most recent information on how the election is held.

Please remember the deadlines for each stage in the election. It is your responsibility to comply with all legal requirements within the mandated time frames.

[GCPR.2204] AMENDMENT TO ARTICLE XIV OF THE CHARTER

This is the voting thread for proposal [GCPR.2204] Amendment to Article XIV of the Charter, which was submitted, debated and motioned on this thread in accordance with the provisions of the Great Council Convening Resolution of 2022.

This proposal requires a majority of three fifths of valid votes cast, excluding abstentions, to advance to the reconciliation and omnibus stage.

HOW TO VOTE

Participants may vote by submitting a reply to this thread that clearly conveys their intent to support, oppose, or abstain from the proposal.

Votes will be considered valid only if they meet the following conditions:

They were cast by a participant, defined as a resident whose name is listed in the Official Dashboard.
They convey an intent to either support, oppose, or abstain from the proposal, but not several at once.
They use the following approved terms to convey intent:

TEXT OF THE PROPOSAL

THE CHARTER OF THE SOUTH PACIFIC

XIV. GREAT COUNCILS

(1) When the Assembly wishes to debate the fundamental principles and structures of the Coalition, it may call a Great Council to rewrite all laws in their entirety, or establish a new state for the South Pacific.
(2) A resolution establishing a Great Council may be adopted with a three-fifths supermajority of the Assembly, which must be confirmed by a majority vote of the gameside community.
(3) The purpose of a Great Council is to rewrite all laws from the ground up, not merely to amend existing ones. The Assembly should use the normal amendment process for basic amendments, reserving Great Councils for a time when extreme changes are necessary and proper.
(4) Any and all changes to regional law proposed by a Great Council may be adopted by a three-fifths supermajority of the Assembly, which must be confirmed by a majority vote of the game-side community.
(5) If a Great Council fails to pass a new constitution and set of laws to replace the existing ones, then the existing laws will remain in place.
(6) At least one year must have passed since the previous Great Council before a new one may be established.

Legality of Running for the Local Council

ARGUMENT
Your honor,

I present to you yet another legal question. This one, concerning about the Local Council Elections Act (LCEA). LCEA mainly serves as a governmental act "detailing elections for the Local Council." However, this legal question will be focusing on Article II, Candidate Eligibility. Under Section I of the article, it states that, "Candidates must be members of the South Pacific with a Residency of at least 120 by the beginning of the nominations period." However, there are multiple of those among current TSP residents who are vying to become our region's next Local Councilors (LCs), though will maintain a high enough residency count in order to become the Councilor. Now, in the situation that a candidate who was planning to run for LC has been in TSP for most of their days, however, took a minute-long stint at another region after accidentally pressing the "Join x_region" button? This was before the either major or minor update. Would this person still be allowed to run for the LC?

I appreciate your work you due for this region.

Does Article 2, Section 1 of the Local Council Elections Act allow those who failed the eligibility process for residency, however, it was a flaw and before an update, to run for Local Councilor?
