  Rules Change: Remove inactive participants

In our first vote, a quarter of participants failed to vote. They should be removed from the Great Council, as this is a body meant to be a vehicle for active debate and consideration of constitutional changes. Inactive participants are not upholding their duties.

After each vote, those who failed to cast a vote should be removed from the participant roster. I bring to the floor the following amendment to our rules of order:

Quote:3. Mandates that legislators of the Assembly holding valid status at the time this resolution is motioned to vote shall automatically qualify for participation in the Great Council, and that all participants must maintain order and decorum and actively participate in all proceedings.
a. Determines that non-legislators may petition the Chair of the Great Council to participate, and that those petitions shall be granted upon determination of the Chair (or Deputy Chair, in the Chair's absence) that the petitioner does not pose a threat to the security or decorum of the Great Council, and that the petitioner does not possess significant conflicts of interests or the appearance of bad faith.
b. Requires the Chair of the Great Council to publish and maintain a list of qualified participants. The Chair will remove from the list and disqualify any participant who fails to cast a vote or explicitly abstain on a measure, at the conclusion of voting on the measure.
c. Permits any participant to raise a point of order that another participant is violating order or decorum, including acting on behalf of a foreign influence, to be judged by the Chair of the Great Council who may then expel a violating participant.
d. Further permits any participant to motion to overrule the Chair of the Great Council (or Deputy Chair, in the Chair's absence) in regards to their determination under 3(a) or 3(c.), which shall be adopted by majority vote.
e. Reasserts that all extant proscriptions and administrative bans remain in effect throughout the Great Council, and that participation in the Great Council shall not be used in defense against any proscription or administrative or moderator action.

There has been a seconded motion to bring a Revival of Leave of Absence Reform, an amendment to the Legislator Committee Act, to vote. The debate thread can be found here.

This is an amendment to constitutional legislation, according to the Legislative Procedure Act requiring a majority greater than 60% to pass. The voting period will be 5 days, thus concluding on (16:00 in London, 11:00 in New York, 01:00 on Aug 31 in Sydney).

Please vote by poll if possible. If you cannot vote by poll, post 'Aye', 'Nay' or 'Abstain' in this thread. Please do not vote both by poll and by post. Comments and discussions belong in the debate thread and should be posted there.

(3) A legislator fails the voting requirement if they are absent for more than half of all votes finished in the previous calendar month, if a minimum of two votes occurred. Legislators who have an approved leave of absence from the Chair shall not be considered absent for votes in the given time frame.

(4) Legislators may request a leave of absence for a definite period of time subject to discretionary approval from the Chair or their deputies. During such time, legislators on a leave of absence are exempt from the voting requirement.

(4) (5) The Chair of the Assembly may order the Legislator Committee to suspend legislator privileges for disruptive members. Frequent suspensions may be grounds for ineligibility, if found appropriate in a fair trial by the High Court.

  TEP moves to a new Forum platform

On 25th August, and after two surveys on the matters whether TEP's forums should settle in a new platform or not and what platform should that be, TEP's citizens have decided to move into Discourse. Now the transition begins to accomplish this decision, which should take some months until the new site is operational. The current forums, hosted in Tapatalk, will remain as an archive.

  Abolish The Great Council

Yes, I said that!

After some talk in the #legislators-lounge on Discord, I found out something...weird. Well, a lot of stuff we found, but I'm talking about the Great Council. The Great Council does...nothing. Why have a Great Council convene if you can just alter the laws of the Charter through the Assembly? Seems a bit...useless to me. 

The Great Council is...silly! Why have a special council potentially do something once per year, when we can always do it in a different body?

So again, why have this special Council when you can do everything through the Assembly? Comments encouraged.

Oh- and to clarify. This would give room for the current GC to end, and after that, we're done.

XIV. GREAT COUNCILS
Setting a procedure for constitutional conventions.
(1) When the Assembly wishes to debate the fundamental principles and structures of the Coalition, it may call a Great Council to rewrite all laws in their entirety, or establish a new state for the South Pacific.
(2) A resolution establishing a Great Council may be adopted with a three-fifths supermajority of the Assembly, which must be confirmed by a majority vote of the gameside community.
(3) The purpose of a Great Council is to rewrite all laws from the ground up, not merely to amend existing ones. The Assembly should use the normal amendment process for basic amendments, reserving Great Councils for a time when extreme changes are necessary and proper.
(4) Any and all changes to regional law proposed by a Great Council may be adopted by a three-fifths supermajority of the Assembly, which must be confirmed by a majority vote of the game-side community.
(5) If a Great Council fails to pass a new constitution and set of laws to replace the existing ones, then the existing laws will remain in place.
(6) At least one year must have passed since the previous Great Council before a new one may be established.

  [DRAFT] [2237.AB] Assembly approval of the Election Commissioner

A month or two ago, I started looking into some of our laws and wrote some slight changes. Somehow, a little less than four weeks ago, this proposal wound up in my Google Docs trash can. I took the pleasure of looking there, and not only did I find some very weird documents I had previously written, but also this. 

Please note that this resolution only suggests one change to the Elections Act and is very minor adjustment. Now, all members of the CRS are qualified, respected, and trusted South Pacificans, however, I do think the Cabinet and the Assembly should get a say in this matter! 

All thoughts are welcomed.

1. Election Commission

(1) An Election Commissioner will be appointed by the Council on Regional Security, with the approval of the Assembly, and after approved and entered office, the Election Commissioner will to administer all forum elections.
(2) The Commissioner will be responsible for the creation of election notices, the organization of election forums, the verification of candidate eligibility, the distribution and collection of ballots, and counting and verifying cast ballots.
(3) The Commissioner may not run for or hold an elected office during their tenure as Commissioner.
a. This does not prohibit the Commissioner from resigning to seek office via an election or finding an accepted surrogate to oversee the election in their place.
(4) The Commissioner will be a permanent position and shall be replaced as needed due to inactivity or ineligibility by the Council on Regional Security. The Assembly may remove, by a majority vote, a Commissioner for abuse of power or neglect of responsibilities.
(5) Any election-related disputes will be arbitrated by the Commissioner; should the dispute be on a matter of law, the Commissioner shall refer it to the High Court. The Commissioner will not finalize any election until all disputes have been settled.
