[Debate] Treaty on the prohibition of nuclear weapons

Ladies and gentlemen,

we as the World Forum have a charter. And this charter reads the following in section A:

"1. The purpose of the World Forum shall be to maintain peace, order, and stability in the world. The member states of the World Forum shall take collective action to ensure that all threats to the peace, order, or stability among them are suppressed.
(...)
3. The purpose of the World Forum shall be to create an era of peace (...) for all"

The Federal Republic of GI-Land wants to propose something, that is overly overdue already: The prohibition of nuclear weapons on the entirety of Pacifica. While many might argue now, that nuclear weapons itself were the cause of perpetual peace for decades now, I need to ask: What is that for a peace, that is only maintainable through fear of total annihilation? What is it worth, that we know how to make a weapon, that can bring unimaginable suffering to thousands of people within a blink of a second? A weapon, that no one can defend themselves of? A weapon, which can still get somehow into the hands of terrorists, like those from the RIM, or even potentially into hands of politicians, that go rogue for one or the other reason, or seem to have fun threatening other nations constantly with the use of such weaponry?

This is not a real peace, it's psychological warfare, which will work just as long as no one actually presses the button. But once this happens, there is no going back for anyone or anything anymore. And with all due respect to the sovereignity of nations and to the scientists, who have helped to develop something, that we now consider a monstrosity: There is and will be no reason at any given point in time, that would excuse the use of nuclear weapons.

A use of such weapons has catastrophic humanitarian consequences. I don't talk about an earthquake or a tsunami, where the international community can help easily, I talk about a situation, where humanitarian aid is potentially impossible, because of the total destruction of infrastructure by nuclear weapons and the high health-related risks we would put any helping person through.

A use of such weapons also does not only affect one nation or a certain area, it can affect the entire world, if we look at fallouts caused by nuclear weapons or even just "normal" nuclear accidents. It also affects the environment heavily, which - with weapons produced nowadays - needs tens of thousands of years to fully recover from a nuclear attack.

A use of such weapons is against the international law, especially the human right to not get harmed, and against any moral compass as the weapons are acting completely indiscrimnate between military and civilian targets. And even IF just military targets WOULD be affected, there is no way to defend oneself from nuclear attacks at all. If one is affected by a nuclear weapon, you are lucky if you were right below the epicentre of the bomb, because you simply evaporate. Everyone else will be killed slowly and painfully in the matter of either minutes, but sometimes even years.

And we shall not forget about the effects the testing of those weapons had on indigenous people and the environment. We produced bigger and "better" nuclear weapons, only a handful of which could destroy the entirety of Pacifica, just so the lie of the "best peace project we ever created" could get upheld by nations, who just wanted profile themselves as powerful and worth more than their neighbours. This is wrong! And it's in our hands to end this once and for all and to create the first big milestone for this World Forum in achieving its goals laid out in its charter.

We propose the following:

Resolution – Treaty on the Prohibition of Nuclear Weapons

Article 1 – Prohibitions

All signatory states and any private or public entity within their territory or at any place under their jurisdiction or control shall never under any circumstance undertake directly or indirectly to:

a) develop, test, produce, manufacture, acquire, possess, stockpile, transfer or receive nuclear weapons or other nuclear explosive devices;
b) use or threaten to use nuclear weapons or other nuclear explosive devices;
c) assist, encourage or induce anyone in any way to engage in any of the above activities and neither seek or receive any assistance in that matter.
d) allow any stationing, installation or deployment of any nuclear weapons or other nuclear explosive devices.


Article 2 – Declarations

Each signatory state shall declare to the Assembly upon accession or the latest one year after this treaty has entered into force whether:

a) they owned, possessed or controlled nuclear weapons or other nuclear explosive devices, or still do own, possess or control such weaponry.
b) there are any nuclear weapons or other nuclear explosive devices in its territory or in any place under its jurisdiction or control, which are owned, possessed or controlled by another state.
c) a programme for the elimination or irreversible conversion of all nuclear-weapons-related facilities has been established prior to this treaty entering into force.

If paragraph a) applies, the signatory state has to make the number of nuclear weapons or other nuclear explosive devices it owns, possesses or controls, or has owned, possessed or controlled transparent to the Assembly.
If paragraph b) applies, the signatory state has to make the number of nuclear weapons or other nuclear explosive devices controlled by another state in its area of jurisdiction or control transparent to the Assembly.
If paragraph c) applies, the signatory state has to make the current progress of the programme transparent to the Assembly.


Article 3 – PNA/The total elimination of all nuclear weapons

1) There shall be a competent international authority, the Pacifican Nuclear Association (PNA), consisting of one representative for each signatory state. The headquarters of the PNA shall be on Government Island.

2) Each signatory state, which owned, possessed or controlled nuclear weapons or other nuclear explosive devices after 1 September 2020 and eliminated its nuclear weapons programme, including the elimination or irreversible conversion of all nuclear-weapons-related facilities, shall cooperate with the PNA for the purpose of verifying the irreversible elimination of its nuclear weapons programme. Furthermore they shall reach a safeguards agreement with the PNA sufficient to provide credible assurance of the non-diversion of declared nuclear material from peaceful nuclear activities and of the absence of undeclared nuclear material or activities in the signatory state’s area of jurisdiction or control.

3) Each signatory state owning, possessing or controlling nuclear weapons or other nuclear explosive devices shall immediately remove those from operational status and destroy them as soon as possible, but not later than the end of 31 December 2024. This deadline also extends to the elimination of a signatory state’s nuclear weapons programme, including the elimination or irreversible conversion of all nuclear-weapons-related facilities. A cooperation with the PNA as laid out in Section B, Article 3, Number 2 shall follow the latest as of 1 January 2025.

4) The PNA shall report yearly to the International Court and the Committee of International Law on the progress made by each signatory state on the elimination of nuclear weapons or other nuclear explosive devices. If necessary the International Court shall, after consultation with the aforementioned Committees and the PNA, impose penal actions on signatory states to enforce the fulfilment of the treaty.


Article 4 – National implementation

1) Each signatory state shall adopt necessary measures in national legislation to implement its obligations under this treaty.

2) Each signatory state shall take all appropriate legal, administrative and other measures, including the imposition of penal sanctions, to prevent and suppress any activity prohibited under this treaty.


Article 5 – Victim assistance and environmental remediation

1) Each signatory state shall adequately provide assistance – without discrimination –, including medical care, rehabilitation and psychological support, to individuals within their area of jurisdiction or control, who were affected by the use or testing of nuclear weapons or nuclear explosive devices.

2) Each signatory state shall environmentally remediate areas under their jurisdiction or control, which were contaminated by the use or testing of nuclear weapons or other nuclear explosive devices.

3) Independently from any other duty or obligation a state might have due to international law, a signatory state that has used or tested nuclear weapons or any other nuclear explosive devices shall have a responsibility to provide adequate assistance to affected states for the purpose of victim assistance and environmental remediation.


Article 6 – International cooperation and assistance

Each signatory state shall:

a) cooperate with other states to facilitate the implementation of this treaty
b) have the right to seek and receive assistance, where feasible, from other states, to fulfil their obligations under this treaty.
c) provide technical, material, financial and humanitarian assistance to states affected by, and victims of the use or testing of nuclear weapons or other nuclear explosive devices, if the signatory state is in a position to do so.


Article 7 – Treaty membership

1) Each signatory state shall encourage states not party to this treaty to sign, ratify, accept, approve or accede to the treaty, with the goal of universal adherence of all states to the treaty.

2) This treaty needs to be ratified, accepted or approved by signatory states. Those signatory states do not have to be members or observers of the World Forum.

3) This treaty shall enter into force for a signatory state 60 days after its ratification, acceptance, approval or accession.

4) Each signatory state has the right, through exercising its national sovereignty, to withdraw from this treaty, if it decides that extraordinary events related to the subject matter of the treaty have jeopardised the supreme interests of its country. It shall give notice of such withdrawal to the PNA, the Speaker and the International Court. Such notice needs to include a statement laying out the extraordinary events, that it regards as having jeopardised its supreme interests.

5) The withdrawal shall take effect 12 months after the date of the receipt of the notification of withdrawal by the International Court. If, however, on the expiry of this 12-month-period the withdrawing signatory state is a party to an armed conflict, the signatory state shall continue to be bound to the obligations of this treaty and of any additional protocols to it until it is no longer party to an armed conflict.


Article 8 – Final provisions

1) The treaty shall be of unlimited duration and its articles shall not be subject to reservations.

2) The Alman, Austral and Sedunnic texts of this treaty shall be equally authentic.

3) The original of this treaty shall be deposited in the World Forum headquarters in Grovne, Sedunn. Certified copies of this treaty shall be deposited at the PNA headquarters on Government Island, at the International Court in Petrovka, Karnetvor, at the Committee for International Law in Gracemaria, Imperial Frost Federation, and at the Committee for Science and Education in Freudstadt, GI-Land.

The Ryccian Federation shall not consent to this strategic absurdity. Unless every single nation in the world accepts to sign this suicidal treaty, we shall not even begin to consider this naïve document built on false hopes, utopian ideals and unrealistic ambitions.

As a nation which has never hosted weapons of mass destruction of any kind, and views them as a threat to the future of humanity, Kaha'i also supports this motion.

Sedunn agrees that we must strive toward a world free of weapons of mass destruction and agrees in principle to what is laid out in the proposed treaty. We have however made it clear that we reserve the right to acquire and use nuclear weapons, should Sedunn come under a direct threat of being attacked by nuclear weapons by a foreign power. Sedunn will only sign if, and only if all other nations do. We hereby declare our intent to so do.

We feel it necessary to address what we see as an issue in the proposed treaty, unrelated to the prohibition of nuclear weapons itself. The special status of Government Island with its deficiencies in jurisdiction regarding for example law enforcement, lack of infrastructure, and general poor accessibility makes it unsuitable for placement of important institutions, infrastructure and other assets, such as the PNA.

To the honourable ambassador of Sedunn, what would your proposal for the seat of the PNA be instead. GI-Land would propose hosting the headquarters inside its borders, but we chose Government Island in this draft at first to have a neutral location reserved.

As for the ambassadors, who have outruled joining this treaty in any way, I would like to emphasise that naturally this treaty can only work, if everyone joins. But it's also logical, that if no one joins now with the reasoning, that no one has joined yet, there will never be a time anyone signs this treaty.
I can announce for GI-Land, that we are definitely signing this treaty and destroy all of our around 200 nuclear weapons, we own. We are also currently in talks with several nations, among which are nuclear powers, which are not members of the World Forum yet, in which we try, with all the soft power we have, to reach an agreement, e.g. a trade deal, which includes clauses, letting those powers join this treaty too. So let me tell you to anyone, who is worried there won't be any nations and especially no nuclear powers joining this treaty, that this is not the case. And to counter the words of the Ryccian delegate: No, nothing of this treaty is unrealistic, it's just nations like yours that make this treaty appear like wishful thinking.

My government has instructed me to inform the World Forum that the Empire will continue to reserve the right to acquire and use nuclear weapons, should the Empire once again come under a direct threat of being attacked by nuclear weapons by any power. The Empire has however noted that they will sign it if all other nuclear powers sign the treaty.


Now that being said, I personally agree that the region must rid itself of these indiscriminate, abominable weapons of mass destruction. Especially in the wake of the 7 Pillars tragedy, when the Terrorist Insurgents of the Reizen Independence Movement detonated 7 Nuclear Warheads in my home province of Reizen killing thousands and irradiating my homeland. Some may continue to cling onto the notion that these weapons are a firm deterrence, but all should know that the users of the 7 nuclear weapons in the Reizen Civil War, the RIM, have lost and subsequently fled into exile. These weapons will not deter a force that remains steadfast in their cause and it is my hope that my fellow countrymen and members of the world cast away these self destructive weapons into the pits of oblivion.

The Ryccian Federation must disagree. In this ragged and chaotic world, one of the tools guaranteeing our sovereignty is our nuclear arsenal. Unless this world turns into a peaceful utopia, we have no intention on forgoing our most powerful deterrent against an invasion of our nation proper, and thus the most powerful ally of peace.
